The Distance Learning (DL) Compliance Team oversees the University of Kentucky’s (UK's) inventory of state licensure programs, conducts regulatory research, manages associated data and publications, and monitors compliance with professional licensure disclosure requirements. In collaboration with academic programs and colleges, the DL Compliance Team conducts licensure research to determine whether UK's state licensure programs meet the educational requirements set by state or territory licensing agencies.

Federal Regulatory Requirements

  1. Enrollment Eligibility for Distance Education Licensure Programs
    Per Federal Regulation 34 CFR 668.14(b)(32), institutions must certify that any program that is designed or advertised to prepare students for professional licensure (or any other term for required state-issued credential) meets educational requirements in their home states, AND, in the states where distance education students are located, to be eligible for Title IV, HEA program funds. This means that a UK state licensure program offering one or more distance education courses, which would allow students to study in another state during their first term, is not eligible for Title IV funds and cannot enroll new students located in that state if the program does not meet, or if UK cannot determine that it meets, the educational requirements for licensure as established by the state’s licensing agency.  However, if a student attests that they intend to seek employment in a different state, where the program meets the licensing requirements (or where the profession is not regulated), they can still apply and be enrolled in the program.
  2. Public Licensure Disclosure
    Per Federal Regulation 34 CFR 668.43(a)(5)(v), institutions are required to publish whether each licensure program’s curriculum meets educational requirements for licensure or certification in all states/territories.
  3. Direct Licensure Disclosure
    Per Federal Regulation 34 CFR 668.43(c), institutions are required to provide direct notice to prospective students when the program's curriculum does not meet the State educational requirements for licensure or certification in the state in which the student is located, or if the institution has not made a determination regarding whether the program's curriculum meets the state educational requirements for licensure or certification. Institutions are also required to provide direct notice within 14 calendar days when a program's curriculum does not meet the state educational requirements for licensure or certification in a state in which a student who is currently enrolled in such program is located.

UK’s State Licensure Programs

Typically, when a program is designed or advertised to prepare students for professional licensure or certification regulated by Kentucky law, and the curriculum meets the educational requirements set by the state licensing agency, it should be designated as a state licensure program. However, there are some circumstances that may lead to a different conclusion. Please see UK’s Licensure Program Identification Policy for details.

UK’s Distance Education PPA (DE-PPA) Licensure Programs

At UK, degree programs leading to state licensure, that include one or more distance education courses allowing students to study outside of Kentucky during their initial term, are designated as DE-PPA Licensure Programs. The DL Compliance Team oversees the identification of DE-PPA Licensure Programs. To view UK’s DE-PPA Licensure Program inventory, refer to the UK DE-PPA Licensure Program Inventory report.

Per Federal Regulation 34 CFR 668.14(b)(32), DE-PPA Licensure Programs are not eligible for Title IV funds in states where the program curriculum either does not meet, or UK cannot determine it meets the educational requirements for licensure set by the relevant state licensing agencies, and therefore, cannot enroll new students located in those states. However, the regulation offers an alternative pathway allowing programs to remain eligible for Title IV funds and to enroll such students if students attest that they intend to seek employment in a state where the program meets educational requirements for licensure (or in a state that does not regulate the profession). Applicants to DE-PPA Licensure Programs are screened during the application process, and if applicable, are provided the opportunity to complete the attestation. Licensure Programs Map

The DL Compliance Team maintains the Program State Licensure Map to indicate whether each state licensure program meets the educational requirements for licensure in each U.S. state/territory. However, updates are made only after an annual review and may not reflect recent changes to the educational requirements for state licensure. Programs should always advise students to check with their state licensure board directly to verify current licensure requirements.

Licensure Research

At UK, the DL Compliance Team conducts licensure research for all state licensure programs by collaborating with each program and college. The process is as follows:

  1. The designated researcher from the DL Compliance Team collects detailed curriculum information from the state licensure program.
  2. Annually, the researcher conducts state-by-state licensure and/or state authorization research as needed.
  3. Upon completing the research, the researcher prepares a detailed compliance report for the program to review and approve.
  4. The relevant program contact(s) and college leadership review the findings, provide feedback, approve the compliance report, and return the signed report to the DL Compliance Team.
  5. The DL Compliance Team documents the signed report, updates the Program State Licensure MapState Authorization Map, and Internal OOS Field Placement Map, as applicable, to reflect the new results.

Direct Licensure Disclosures

  1. The DL Compliance Team oversees the educational licensure requirements for state licensure programs and sends direct disclosure notices to applicants who apply through UK’s application system (Slate). For state licensure programs using external application systems, program staff must coordinate with the DL Compliance Team to ensure that appropriate direct disclosures are provided.
  2. The DL Compliance Team also monitors the educational licensure requirements for current students enrolled in state licensure programs and provides direct disclosure notices to these students accordingly.

In accordance with Federal Regulation 34 CFR 668.43(a)(5)(v), a link directing students to the public licensure disclosure must be prominently displayed and easily accessible on the state licensure program’s webpage. Frequently Asked Questions

Federal regulations for professional licensure programs apply to all modalities, without exclusion. At UK, the Distance Learning Compliance team oversees all state licensure programs, regardless of their modality.

The identification of a state licensure program is determined collaboratively by the program, the college, and the DL Compliance Team, in accordance with UK’s Licensure Program Identification Policy. For inquiries, please contact distancelearning@uky.edu

Institutions are required to determine whether the curriculum of each state licensure program meets the educational requirements for licensure in each state or territory, as set by its respective licensing agency. However, meeting these educational requirements does not guarantee that program completers will be able to secure licensure in a state or territory. As stated in our licensure disclosures on the Program State Licensure Map: "Additional requirements such as examinations, background checks, supervised professional experience, fees, etc., may apply. The licensing board will evaluate each application in its entirety before making a final decision regarding certification."

State Authorization refers to whether out-of-state educational activities, such as online programs or field placements, can be conducted in a particular U.S. state or territory. This applies to distance education programs offering online courses as well as on-campus programs that include out-of-state field placements.

State Licensure, on the other hand, pertains to whether a program’s curriculum meets the educational requirements for licensure set by a state’s licensing agency. This applies specifically to state licensure programs, regardless of modality.

UK designates the DL Compliance Team to conduct licensure research for all state licensure programs in collaboration with the respective programs. However, state licensure programs and the relevant colleges are responsible for reviewing the research findings and ensuring their accuracy.

Per Federal Regulation 34 CFR 668.14(b)(32), if your program is categorized as a "DE-PPA Licensure Program" (see the UK DE-PPA Licensure Program Inventory), it cannot enroll new students from that state unless a student completes an attestation that they plan to seek employment in a state where the program meets the educational requirements for licensure (or in a state that does not regulate the profession). If your program is not categorized as a "DE-PPA Licensure Program," you may still enroll students from the state, but you must ensure that students understand that they may not be able to obtain licensure in that state.

The DL Compliance Team aims to review each state licensure program annually. However, due to the high volume of state licensure programs at UK, some programs may be reviewed biennially, particularly when licensing requirements in those fields change infrequently.

The program director or compliance liaison (if different) should thoroughly review the compliance report to ensure the accuracy of the research findings provided by the DL Compliance team. If the report includes significant changes from the previous year, it must be signed by both the program director and the college administrator responsible for overseeing compliance. If there are no major changes, signatures are not required.

Sometimes, a program may become aware of changes to licensure requirements in a specific state/territory or learn of a student who successfully obtained licensure in a state/territory labeled as “does not meet” or “cannot determine.” In such cases, please forward the supporting details to the DL Compliance Team. We will collaborate to determine whether the licensure status should be updated, regardless of the review cycle.
